Application for Designation as a Senior-Friendly Company or Institution

Designation as a senior-friendly company or institution is a system under Article 13 of the Act on the Support for Senior Employment and Social Activities, in which the Minister of Health and Welfare designates companies, public institutions, community business groups and similar entities that employ seniors above a set threshold. Under Article 13 of the Enforcement Decree, the Korea Labor Force Development Institute for the Aged is entrusted with supporting the designation and runs it as an open call. Under Article 8 of the Enforcement Rule, companies, non-profit corporations, cooperatives, social enterprises and similar entities must have operated for at least 1 year, have at least 5 regular workers as of the end of the previous year, employ seniors amounting to at least 5/100 of their workers and no fewer than 5 persons, and plan to employ at least 5 seniors every year for 5 consecutive years starting the year after designation. Requirements set by the Minister's public notice, such as prior-year sales, also apply. Sole proprietors qualify only if they intend to convert into a corporation after designation, and those founding a new company that hires seniors apply separately for start-up support for senior-hiring companies under Article 11 of the Act. If a designated entity no longer meets the criteria, the designation is cancelled after a hearing under Article 14 of the Act.

Procedure

Procedure

  1. 01

Choose the application type: an existing company maintaining or expanding senior employment applies for senior-friendly company designation (Enforcement Rule Articles 8 and 9); a newly founded company hiring seniors applies for start-up support for senior-hiring companies (Enforcement Rule Article 6, Form No. 4). Entities designated as a senior-hiring company or community business group cannot receive the support under Article 8(2) of the Enforcement Rule, such as costs for improving the work environment.

  2. 02

Check legal form and operating period: eligible entities are companies and limited partnerships, non-profit corporations and associations, registered non-profit civic organizations, social enterprises, cooperatives and public institutions, with at least 1 year of operation. Sole proprietors may apply only if they intend to convert into a corporation after designation, so the conversion timing is stated in the business plan.

  3. 03

Check employment figures as of the end of the previous year: at least 5 regular workers and senior employment of at least 5/100 of workers and no fewer than 5 persons are assessed as of the end of the previous year. These figures cannot be changed once the call opens, so they are checked in the second half of the previous year using social insurance enrollment records and industrial accident insurance employment data; the age counted as a senior is confirmed against Article 2 of the Enforcement Decree and that year's announcement.

  4. 04

Prepare the business plan and matching investment plan: the business plan for creating senior jobs and improving the work environment sets out yearly headcounts for employing at least 5 seniors each year for 5 years from the year after designation, and the items and amounts in the matching investment implementation plan for the financial support must be consistent with the business plan. Public-notice requirements such as prior-year sales are checked against the prior-year financial statements.

  5. 05

Apply during the call period: the designation application (Enforcement Rule Form No. 7), with the plans and articles of incorporation attached, is submitted within the period and by the method stated in the Korea Labor Force Development Institute for the Aged announcement. The business registration certificate, standard financial statement certificate, tax payment certificates, social insurance premium payment certificate and industrial accident insurance employment information certificate need not be submitted if the applicant consents to administrative information sharing.

  6. 06

Post-designation management: once designated, the entity receives a designation certificate (Form No. 8) and may use the designation mark as set out in Enforcement Rule Annex 2. The planned headcount must be maintained every year; if the entity no longer meets the criteria or was designated through false means, the designation is cancelled after a hearing, and the certificate must be returned and the mark removed.

Employment figures are assessed as of the end of the previous year and cannot be supplemented once the call opens, and a designation is cancelled if the 5-year employment plan is not kept and the criteria are no longer met, so a yearly hiring plan should be set before applying.
