Amending Apartment Management Rules and Reporting — Majority Approval of Residents, Report to the City, County or District Within 30 Days

Under Article 18 of the Multi-Family Housing Management Act, apartment management rules are the self-governing rules of a housing complex that residents set with reference to the standard management rules issued by the mayor or governor of the metropolitan city or province, and they also bind persons who succeed to a resident's status. To amend the rules, a draft stating the purpose of the amendment, the changes from the existing rules and the differences from the standard rules is posted on the complex website and on each building's notice board, and a summary of the draft is sent to each resident; the amendment is then proposed by resolution of the residents' representative council or in writing by at least one tenth of all residents and decided by approval of a majority of all residents. Approval may be given in writing or by electronic voting. Once the amendment is complete, the chair of the residents' representative council must report it to the competent city, county or district within 30 days of the amendment, and failure to report is subject to a fine for negligence of up to 3,000,000 won.

Procedure

  1. 1. Identify the reasons for amendment and compare with the standard rules

Compare the current management rules with the latest standard management rules of the metropolitan city or province article by article and list the parts that need to be amended. The standard rules cover items such as the election and dismissal procedures for building representatives, the operation of the election management committee, calculation and collection of management fees, the long-term repair reserve rate, accounting audits, floor noise and secondhand smoke, identity verification for electronic voting, and the prohibition of harassment of security guards and other workers, so first check whether amendments to the standard rules have been reflected in the complex's rules. For any article that will differ from the standard rules, write down the reason separately.

  2. 2. Draft and propose the amendment

The draft must state the purpose of the amendment, the changes from the existing rules and the differences from the standard rules. The amendment may be proposed by resolution of the residents' representative council or in writing by at least one tenth of all residents, so for a council proposal the resolution is recorded in the meeting minutes, and for a resident proposal a signed list of proposers is prepared.

  3. 3. Public notice, individual notice and voting

Post the draft on the complex website and each building's notice board (including entrance notice boards, if any), and send a summary of the draft to each resident. The amendment is then decided by approval of a majority of all residents, and votes may be collected by electronic voting instead of written consent. When electronic voting is used, identity must be verified through mobile phone authentication, a certificate or a similar method, and residents must be informed in advance of the voting method and period.

  4. 4. Report the amendment to the city, county or district

Within 30 days of the amendment, the chair of the residents' representative council submits the report form on the establishment and amendment of management rules to the mayor, county head or district head, together with the amendment proposal and the residents' consent forms. The city, county or district must notify whether the report is accepted within 7 days of receiving it, and if neither acceptance nor an extension of the processing period is notified within that period, the report is deemed accepted on the day after the period ends.

  5. 5. Keep the amended rules and respond to inspection requests

Once the report is accepted, the management entity keeps the amended rules and must comply when a resident requests to inspect them or to make copies at their own expense. If amended articles affect how management fees are charged or how elections are run, the management office's charging standards and the election management committee's operating rules are also updated.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • Collecting votes without posting the draft publicly and sending the summary individually may leave a defect in the amendment procedure, so keep records of the postings and notices as part of the report documents.
  • The approval threshold is a majority of all residents, not of those who voted, so the list of all households and residents must be finalized before counting consent forms.

Frequently asked questions

How many residents must approve an amendment to apartment management rules?
A majority of all residents must approve it. The amendment may be proposed by resolution of the residents' representative council or in writing by at least one tenth of all residents, and in either case it is decided by majority approval after the draft is publicly posted and individually notified.
By when must an amendment to the management rules be reported?
It must be reported to the city, county or district within 30 days of the amendment. The person obliged to report is the chair of the residents' representative council, and failure to report may result in a fine for negligence of up to 3,000,000 won under Article 102, Paragraph 4 of the Multi-Family Housing Management Act.
Can the rules differ from the standard management rules?
Residents set the management rules with reference to the standard rules, so they can be set differently to suit the complex. However, the draft must state the differences from the standard rules and be publicly posted and notified, and content that conflicts with laws cannot be adopted, so the legal basis of each article is checked.
Can the vote on amending the management rules be held electronically?
Yes. Decisions on multi-family housing management, including written consent, may be made electronically, and identity must be verified through a prescribed method such as mobile phone authentication or a certificate. Whoever conducts the vote must inform residents in advance of the electronic voting method and period.
When will the city, county or district respond to the report?
It must notify whether the report is accepted within 7 days of receiving it. If it does not notify acceptance or an extension of the processing period within that period, the report is deemed accepted on the day after the period ends.
Does an administrative agent handle amending and reporting apartment management rules?

Hwang Yunsang Administrative Office prepares a comparison table between the current rules and the standard management rules, drafts the amendment and its summary, prepares templates for the public notice, written consent forms and electronic voting notice, and prepares and submits the report form on the establishment and amendment of management rules to the city, county or district on the client's behalf.
