Floor Noise Dispute Mediation Application — Apartment and Environmental Dispute Committees, Filing Order and Noise Standards

A resident of a multi-unit apartment who suffers floor noise can, under Article 20 of the Multi-Family Housing Management Act, notify the management entity and ask it to recommend that the noise stop, and if the noise continues, apply to the floor noise management committee for mediation. If the noise continues even after the management entity or the floor noise management committee acts, the resident can apply for mediation to the multi-family housing management dispute mediation committee or the environmental dispute mediation and damage relief committee. The central multi-family housing management dispute mediation committee must present a mediation proposal within 30 days from the start of the procedure, and environmental mediation must be completed within 9 months. Whichever committee is chosen, a dated record of complaints, recommendations and noise logs forms the basis of the application.

Procedure

  1. 1. Notify the management entity of the damage

Notify the management entity, such as the management office, in writing of the floor noise and ask it to recommend that the unit causing the noise stop or take soundproofing measures. The management entity may conduct necessary investigations, including checks inside the unit, to confirm the facts, and the unit causing the noise must cooperate with the recommendation. Recording the date of the request and the management entity's measures allows them to be used directly in the negotiation history statement later.

  2. 2. Apply to the floor noise management committee

If the noise continues despite the management entity's measures, apply for mediation to the floor noise management committee formed under the management rules. Among complexes subject to mandatory management, those with 700 or more households must form this committee, while smaller complexes may or may not have one depending on their management rules, so check with the management office first.

  3. 3. Organize noise records and negotiation history

Keep a log of the dates, times and types of noise (direct impact noise from running or walking, and airborne noise from audio equipment and the like) and collect recordings and measurement data. Compile the management entity requests, committee mediation and conversations between the parties in chronological order with supporting evidence to prepare the negotiation history statement. Water supply and drainage noise from bathrooms and toilets is excluded from floor noise under the Rule, so describe each type of noise separately.

  4. 4. Choose the committee to apply to

Multi-family housing management disputes are handled in principle by the local dispute mediation committee of the city, county or district, and by the central dispute mediation committee of the Ministry of Land, Infrastructure and Transport when the dispute spans two or more cities, counties or districts, when there is no local committee, or when both parties agree. For the environmental dispute mediation and damage relief committee, apply to the local committee of the province or metropolitan city choosing either conciliation (3 months) or mediation (9 months), with the period in parentheses being the deadline for completing the procedure.

  5. 5. Prepare and submit the application and review the proposal

Submit to the central multi-family housing management dispute mediation committee an application on Appended Form No. 39 with the negotiation history statement and a copy of the applicant's ID, while local committees use the form set by city, county or district ordinance. When the central committee presents a mediation proposal, the parties must notify acceptance or rejection in writing within 30 days of receipt, and if no response is given within that period, the proposal is deemed accepted. An accepted mediation document has the same effect as a judicial settlement.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • Repeatedly visiting the other unit in person to complain can lead to a separate dispute, so it is safer to keep records through written channels such as requests to the management entity and committee applications.
  • A proposal from the central multi-family housing management dispute mediation committee is deemed accepted if not answered within 30 days, so record the date of receipt immediately.

Frequently asked questions

What decibel level is the floor noise standard?
For direct impact noise from running or walking, the 1-minute equivalent sound level standard is 39dB(A) in the daytime and 34dB(A) at night, and the maximum sound level is 57dB(A) in the daytime and 52dB(A) at night. For airborne noise from audio equipment and the like, the 5-minute equivalent sound level is 45dB(A) in the daytime and 40dB(A) at night, with daytime running from 06:00 to 22:00. The maximum sound level is considered exceeded only when it is exceeded 3 or more times in an hour.
Do older apartments have the same standard?
For direct impact noise, 2dB(A) is added. For multi-family housing that received a building permit under the Building Act and housing approved for a project on or before June 30, 2005, 2dB(A) has been added to the direct impact noise standard since January 1, 2025.
Can I apply directly to a dispute mediation committee without going through the management office?
The order set by law is to go through the management entity and the floor noise management committee first. Article 20(11) of the Multi-Family Housing Management Act allows an application to a dispute mediation committee when floor noise continues despite the measures of the management entity or the floor noise management committee, and the application must include the negotiation history statement.
Should I apply to the multi-family housing management dispute mediation committee or the environmental dispute mediation and damage relief committee?
Both committees accept applications. The multi-family housing management dispute mediation committee handles floor noise under the Multi-Family Housing Management Act, and the central committee in principle presents a proposal within 30 days, while the environmental dispute mediation and damage relief committee treats noise damage as environmental damage, offers conciliation and mediation, and completes mediation within 9 months. It is best to choose one based on the damage and the outcome you want.
What happens if I do not respond to a mediation proposal?
For a proposal from the central multi-family housing management dispute mediation committee, failing to notify acceptance or rejection in writing within 30 days of receipt means the proposal is deemed accepted. An accepted mediation document has the same effect as a judicial settlement, so review it and submit a response within the deadline.
Does an administrative agent prepare floor noise dispute mediation applications?
Yes. Hwang Yunsang Administrative Office organizes noise logs and the negotiation history, prepares the negotiation history statement and the dispute mediation application, compiles an evidence list, and submits them to the committee on the client's behalf. We also prepare the floor noise damage report to the management entity and the floor noise management committee mediation application.
