Livestock product processing & distribution

Egg Collection and Sales Business Report — Distribution Needs Only a Report, Repackaging Requires HACCP Certification or the 300-Egg Bulk Exception

An egg collection and sales business collects, processes or buys eggs and sells them as a specialized business, and it is a livestock product sales business report under Article 24 of the Livestock Products Sanitary Control Act and Article 21, Item 7(f) of its Enforcement Decree, not under the Food Sanitation Act. After preparing the business premises and completing 6 hours of new-operator hygiene training, you file a business report with the city, county or district where the premises are located, and the office notifies acceptance within 3 days. Eggs must in principle be graded and packed at an egg grading and packing plant, and repackaging packed eggs for sale is prohibited except for bulk packs of 300 or more eggs bought from another egg collection and sales operator or where the operator holds HACCP (safety management certified business) certification. A plain distribution business can therefore start with the report alone, while a business that plans to subdivide or repackage should schedule certification at the same time.

Procedure

  1. 1. Confirm whether a report is required

An egg collection and sales business collects, processes or buys eggs and sells them as a specialized business, and it files a report with the livestock department of the city, county or district. A report is not required where a farm sells all the eggs it produces to egg grading and packing operators or egg collection and sales operators, where packed eggs are sold as they are to final consumers at a food store or another livestock product sales business, or where a mail-order seller entrusts storage and delivery to a grading and packing operator or an egg collection and sales operator. Sales by a grading and packing operator of eggs it graded and packed itself are also excluded.

  2. 2. Decide how you will distribute eggs and whether you will repackage

Eggs must in principle be graded and packed at the plant of an egg grading and packing operator, so eggs collected from farms are sent to the plant with a grading and packing request on Form No. 41. Repackaging packed eggs for sale is prohibited, with exceptions only for bulk packs of 300 or more eggs bought from another egg collection and sales operator (excluding eggs packed at a grading and packing plant or imported packed eggs) and for HACCP-certified egg collection and sales operators repackaging eggs packed at a grading and packing plant or imported eggs packed at a registered overseas facility. Each smallest pack may contain only eggs from the same farm laid on the same date.

  3. 3. Prepare the business premises

The premises must be a separate building or be separated or partitioned from facilities used for other purposes, with equipment for candling, sorting, packing and transporting eggs and, if you print dates, printing equipment. You need to block direct sunlight, install rodent and insect control and ventilation, and have cooling to keep storage temperatures, and a workroom handling refrigerated eggs must stay within 15℃. If you transport eggs yourself, you need a vehicle that blocks direct sunlight, and refrigerated eggs must be carried in a vehicle with a refrigerated cargo box.

  4. 4. Complete hygiene training and health checks, then submit the report

Anyone who intends to operate must complete 6 hours of livestock product hygiene training and may not operate without it. Operators and employees who directly handle unpacked eggs must have a health examination before starting, while those who only store, transport or sell fully packed eggs are exempt. Submit the Form No. 23 business report marked as an egg collection and sales business with the facility details and layout, plus a facility use contract if the premises are leased, and you will be notified of acceptance within 3 days and issued a report certificate.

  5. 5. Obligations after opening and change reports

Record egg collection, packing and sales in the Form No. 40 transaction and disposal record and keep it for at least 6 months, and collect only eggs produced at farms with a livestock farming permit or registration. You may not store, display or sell eggs outside the premises, or sell to the general public from a vehicle other than for delivery. After opening, complete 3 hours of hygiene training every year, and file a change report on Form No. 27 within 7 days when the trade name, location, area or facilities change.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • Subdividing packed eggs without confirming that a repackaging exception applies breaches operator compliance obligations, so if certification is required, obtain it before you start selling subdivided eggs.
  • Operating an egg collection and sales business without a report can lead to imprisonment of up to 1 year or a fine of up to 10,000,000 won, so obtain the report certificate before you start collecting and selling eggs.

Frequently asked questions

Is an egg collection and sales business reported under the Food Sanitation Act?
No. Under current law, the egg collection and sales business is a livestock product sales business under Article 21 of the Livestock Products Sanitary Control Act and is reported to the city, county or district under Article 24 of the same Act. The report uses Form No. 23 of the Enforcement Rule of the Livestock Products Sanitary Control Act, and hygiene training and facility standards also follow that Act.
Can I open packed eggs and repack them into smaller packs for sale?
In principle, no. An egg collection and sales operator may not repackage packed eggs for sale, except for bulk packs of 300 or more eggs bought from another egg collection and sales operator, or where a HACCP-certified operator repackages eggs packed at a grading and packing plant or a registered overseas facility. If you plan to subdivide, settle the workroom partition and the certification application schedule before filing the report.
How does an egg collection and sales business differ from an egg grading and packing business?
One is a report and the other is a permit. An egg grading and packing business specializes in grading, washing, drying, sterilizing, candling and packing eggs, requires a permit from the city or provincial governor and must follow HACCP standards, while an egg collection and sales business starts with a report to the city, county or district. Eggs that a collection and sales operator gathers from farms are in principle sent to a grading and packing operator's plant for grading and packing.
Can I file an egg collection and sales business report on a poultry farm?
Yes, under conditions. A person holding a chicken farming or breeder farming permit or registration who uses part of the egg collection and storage facilities is deemed to have business premises, but these must be separated or partitioned from the actual rearing facilities with no risk of cross-contamination. An operator who collects eggs directly from the farm and sells them must test the eggs it sells for compositional standards (unless a designated testing and inspection institution has tested them), so also check the standards for an on-site testing room.
Does an administrative agent handle egg collection and sales business reports?
Yes. Hwang Yunsang Administrative Office reviews whether a report is required and your repackaging plans, prepares the business report and the facility details and layout, and submits them to the city, county or district on your behalf. If you intend to repackage, we also prepare and submit the HACCP certification application and its attachments, and prepare change reports after the report is accepted.
