Fertilizer Import Business Report — Report Form and Component Analysis by Fertilizer Type

Anyone who intends to import fertilizer as a business for sale or free distribution must report the manufacturing materials, guaranteed components and other details for each fertilizer type to the mayor, county governor or district head with jurisdiction over the place of business under Article 12 of the Fertilizer Control Act. Fertilizer production requires registration, but fertilizer import requires a report, and the local office must notify whether the report is accepted within 7 days of receipt. The report certificate is issued only if the imported fertilizer meets the official standards and the guaranteed and harmful component criteria.

Procedure

  1. 1. Check official standards and the fertilizer type

First check which fertilizer type in the official standards announced by the Minister of Agriculture, Food and Rural Affairs the imported fertilizer falls under. For fertilizer without official standards, the setting of standards must be requested, and it cannot be imported for storage, display, sale, distribution or supply until they are set (Article 4(5) of the Fertilizer Control Act, except for testing or research). Reports are made for each fertilizer type, so multiple products are prepared type by type.

  2. 2. Prepare manufacturing and material documents and the analysis report

The manufacturing process, raw materials and their input ratios are obtained from the overseas manufacturer and organized by fertilizer name. The analysis report on guaranteed components, harmful components and other specifications must be the result of analysis by a testing and research institution designated and announced by the Administrator of the Rural Development Administration using the announced quality inspection methods (Article 7(4) of the Enforcement Rule). A cultivation test report is also required for fertilizer whose official standards require review of cultivation test results.

  3. 3. Complete the report form and file it with the local office

The fertilizer import business report (Form No. 13 of the Enforcement Rule) states the reporter, the location of the place of business (including the storage warehouse), the type and name of the imported fertilizer, guaranteed and harmful component amounts and the country of import, and is filed with the fertilizer division of the city, county or district office governing the place of business. The fee set by local ordinance is paid.

  4. 4. Review and issuance of the report certificate

If the fertilizer meets the official standards and the guaranteed and harmful component criteria and no restriction ground applies, the mayor, county governor or district head records it in the report ledger and issues the fertilizer import business report certificate (Form No. 15). Notice of acceptance must be given within 7 days of receipt, and if neither notice nor an extension notice is given in time, the report is deemed accepted on the day after the period ends (Article 12(4) and (5) of the Act).

  5. 5. Guarantee labeling and change, suspension or closure reports

Containers or packaging of imported fertilizer must carry guarantee labeling such as the fertilizer name, guaranteed component amounts and the expiry period set in the official standards (Article 14(1) of the Act). Changes to reported matters or closure must be reported within 30 days, and changes of raw materials or addition of fertilizer names require attaching the analysis report and other documents again. A suspension of 6 months or more must be reported in advance.

Frequently asked questions

Is a fertilizer import business a registration or a report?
It is a report. Fertilizer production under Article 11 of the Fertilizer Control Act requires registration, while fertilizer import under Article 12 requires a report to the mayor, county governor or district head for each fertilizer type. Unlike production, fertilizer import has no separate statutory facility standards, and the report form states the location of the place of business and storage warehouse.
Where is the fertilizer import business report filed?
With the city, county or district office governing the place of business. Article 14(1) of the Enforcement Decree requires filing with the mayor, county governor or district head with jurisdiction over the place of business, and in practice the fertilizer division handles it. The processing period is 7 days.
Can overseas fertilizer without official standards be imported and sold?
Not until official standards are set. Article 4(5) of the Fertilizer Control Act requires those who intend to sell or supply such fertilizer for agricultural use to request the setting of official standards, and prohibits importing it for storage, display, sale, distribution or supply until they are set. Import for testing or research is an exception.
What happens if fertilizer is imported and sold without the report?
It is subject to criminal penalties. Under Article 27(2) of the Fertilizer Control Act, anyone who imports and sells or supplies fertilizer without reporting may be punished by imprisonment of up to 3 years or a fine of up to 30,000,000 won, or both, and a corporation may also be fined under the joint penalty provision (Article 29).
Is a new report needed when adding imported fertilizer products?
Yes, a change report is required. Changes to reported matters must be reported within 30 days using Form No. 11, and adding fertilizer names or changing raw materials requires attaching the analysis report and manufacturing process and material documents (Article 11(2) of the Enforcement Rule).
Can an administrative agent prepare the fertilizer import business report?
Yes. Hwang Yunsang Administrative Office reviews whether the imported fertilizer falls under the official standards, prepares the fertilizer import business report, organizes the manufacturing process and material documents, and files them with the city, county or district office on the client's behalf.
