Reporting the Appointment of an Information and Communications Facility Maintenance Manager — Application Dates and Fines for Buildings of 5,000㎡ or More
The owner or manager (managing entity) of information and communications facilities installed in a building classified by use under the Building Act with a total floor area of 5,000㎡ or more (excluding multi-unit housing and some school facilities) must appoint an information and communications facility maintenance manager or outsource maintenance work to an information and communications construction business operator. Existing buildings newly covered by the amendment of the Enforcement Decree on October 29, 2024 are deemed to have appointed a manager until July 18, 2025 for 30,000㎡ or more, July 18, 2026 for 10,000㎡ or more but less than 30,000㎡, and July 18, 2027 for 5,000㎡ or more but less than 10,000㎡, so the obligation applies from the following day. When a manager is appointed or dismissed, an appointment or dismissal report must be filed with the city, county or district within 30 days, and after a dismissal a new manager must be appointed within 30 days. The managing entity must conduct a performance inspection at least once a year and keep the inspection records for 5 years. Failing to appoint a maintenance manager or to prepare inspection records is subject to a fine of up to 3,000,000 won, and failing to file an appointment or dismissal report is subject to a fine of up to 1,000,000 won.
Procedure
1. Check whether the building is covered and when the rule applies
The building register is used to check the use and total floor area and whether the building is a use-classified building of 5,000㎡ or more. Multi-unit housing and school facilities subject to the School Facilities Business Promotion Act are excluded, but school facilities designated by public notice of the Minister of Science and ICT are covered. For existing buildings the rule applies from the day after the special-case date for their area; for new construction or extensions the manager must be appointed within 30 days from the completion date such as the use approval date, and for a change of use within 30 days from the date it is entered in the building register.
2. Decide between direct appointment and outsourcing to a construction business operator
For direct appointment, 1 technical-track information and communications engineer who has completed at least 20 hours of maintenance manager certification training and holds the grade required for the floor area is appointed. The grade is special grade for 60,000㎡ or more, advanced or higher for 30,000㎡ or more but less than 60,000㎡, intermediate or higher for 15,000㎡ or more but less than 30,000㎡, and beginner or higher for 5,000㎡ or more but less than 15,000㎡, and one person may be appointed for up to 5 buildings. If maintenance work is outsourced to an information and communications construction business operator, a manager is deemed appointed, and the contracted operator appoints a maintenance manager meeting the standards.
3. Prepare the appointment or dismissal report and submit it to the city, county or district
Within 30 days from the appointment or dismissal date, the appointment and dismissal report is filed with the city, county or district together with an employment certificate (a copy of the outsourcing contract if outsourced), a copy of the career record book and the information and communications engineer career confirmation. The certificate of business registration and the building register are checked by the official through administrative information sharing, and the processing period on the form is 3 days. If a certificate is needed, an application for an appointment report certificate is filed at the same time.
4. Establish the maintenance and performance inspection plan
Before the first inspection, the managing entity establishes a plan containing a status table of facilities subject to inspection, maintenance and performance inspection procedures, industrial accident prevention measures, an emergency manual and response methods when abnormalities occur. The as-built drawings of the information and communications facilities and the installation status table are kept, and the plan is updated when details change due to accidents, repairs or replacements. The maintenance manager inspects the appearance, function and safety of the facilities at least once every half year based on the completion date and records the results in an inspection sheet.
5. Annual performance inspection, record retention and change reports
A performance inspection is conducted at least once a year based on the completion date, the results are recorded in a performance inspection sheet and kept for 5 years, and they are submitted when the city, county or district requests. Performance inspections may be delegated to a construction business operator or a service provider. If the managing entity's trade name or address, or the maintenance manager's address, grade or career record book number changes, a change report is filed within 30 days.
