Permit Procedure for an Intermediate Waste Disposal Business — Notice of Suitability of the Business Plan and Facility and Technical Personnel Standards by Disposal Method

An intermediate waste disposal business is a business of intermediate disposal of waste by methods such as incineration, mechanical disposal, and chemical or biological disposal. First submit a waste treatment business plan and receive a notice of suitability, then put in place the facilities, equipment and technical capability within the deadline and apply for the permit. Designated waste is handled by the Ministry of Climate, Energy and Environment (regional environmental offices), and other waste by the metropolitan city or province (si/do).

Procedure

  1. 1. Decide the disposal method and the waste to be handled

First decide which of incineration, mechanical disposal, and chemical or biological disposal you will carry out, and the types of waste to be disposed of. The minimum facility capacity and the qualifications of technical personnel differ by method.

  2. 2. Submit the waste treatment business plan

Attach the disposal plan (plans for facility installation, equipment and securing technical capability) to the business plan and submit it to the metropolitan city or province (si/do) or the regional environmental office having jurisdiction over the planned site of the facility. If the facility is an emission facility, also submit the documents for the emission facility permit or report; if it is an incineration facility, also submit an environmental review report.

  3. 3. Review of suitability

The administrative agency reviews the grounds for disqualification, whether the location conflicts with other statutes, whether the facilities, equipment and technical capability meet the permit standards, and the effect on the water quality of water supply sources and on environmental standards, and then gives notice of whether the plan is suitable. Location restrictions, a mismatch between treatment capacity and volume, and differences in figures between documents often come up as grounds for unsuitability.

  4. 4. Install the facilities and secure personnel

Put in place the facilities, equipment and technical personnel within 2 years from the date of receiving the notice of suitability (3 years if an incineration facility must be installed). If there is an unavoidable reason such as a natural disaster, you can apply for an extension of up to 1 year in total.

  5. 5. Apply for the permit

Attach the specifications of the facilities and equipment and the qualification documents for technical capability to the permit application form and submit it. If you meet the requirements in accordance with the plan for which the notice of suitability was given and apply, the administrative agency grants the permit without delay.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • Before a site contract or an equipment order, first check whether the location conflicts with other statutes.
  • Make the treatment capacity and volume figures identical across the business plan, the disposal plan and the emission facility documents.

Frequently asked questions

Can I apply for an intermediate waste disposal business permit right away?
In principle, no. It is a 2-step procedure in which you first submit a waste treatment business plan and receive a notice of suitability, and then apply for the permit. If you intend to run the business inside an industrial complex or a recycling complex, you can apply for the permit without the business plan procedure.
By when must the permit be obtained after the notice of suitability?
Within 2 years from the date of receiving the notice. It is 3 years if an incineration facility must be installed, and if there is an unavoidable reason you can apply for an extension of up to 1 year in total. If the period is exceeded, the business plan procedure must be gone through again.
What are the minimum facility standards by disposal method?
For waste other than designated waste (excluding construction waste), a business specializing in incineration needs 2 tons or more per hour, a business specializing in mechanical disposal 200 kilograms or more per hour, and a business specializing in chemical or biological disposal 5 tons or more per day. In common, facilities that can store at least 10 days' worth and not more than 30 days' worth of the 1-day disposal capacity, and at least 1 set of weighing facilities, are required.
How many technical personnel are required?
For waste other than designated waste, 1 or more persons. For a business specializing in incineration, an industrial engineer in waste treatment or an industrial engineer in air environment is recognized; for a business specializing in mechanical disposal, an industrial engineer in water quality environment, an industrial engineer in noise and vibration and a craftsman in environment are recognized in addition to these.
If I haul in the waste myself, is a separate collection and transport business permit required?
No. The holder of an intermediate disposal business permit may itself collect and transport the waste it is to treat, and in that case must have 1 or more sealed-type collection and transport vehicles.
Does an administrative agent prepare the waste treatment business permit documents on my behalf?
Yes. Hwang Yunsang Administrative Office reviews the requirements by disposal method, prepares the business plan and the disposal plan, cross-checks the figures between attached documents, files with the metropolitan city or province (si/do) or the regional environmental office on your behalf and responds to requests for supplementation, and prepares the permit application form.
