Obtaining a Debtor's Resident Registration Abstract with a Certificate of Interested-Party Facts — Documents After a Returned Certified Letter and the 500,000 Won Threshold
As a rule, only the person and members of their household may obtain a resident registration abstract, but Article 29, Paragraph 2, Subparagraph 6 of the Resident Registration Act allows a person with a legitimate interest, such as a creditor-debtor relationship, to apply for another person's abstract. Claims between individuals and corporations are limited to cases where the benefit of time has been lost or the repayment date has arrived, and debts of 500,000 won or less between individuals are excluded (Enforcement Decree, Annex 2, Item 4). The application is submitted either with claim documents such as a contract bearing the signatures or seals of both parties and the repayment date plus the returned certified letter, or with a certificate of interested-party facts prepared by an administrative agent or similar professional plus the returned certified letter. The certificate must be the original with an issue number written in the evidence section of the application form (Enforcement Rule of the Resident Registration Act, Form No. 11), and the applicant must submit the application in person at a community service center or similar office.
Procedure
1. Check eligibility to apply for the abstract
Check whether the repayment date of the claim has passed or the benefit of time has been lost, and whether the debt between individuals exceeds 500,000 won. Persons involved in the creation, change or extinction of rights over real estate or similar property may apply regardless of amount under Annex 2, Item 2, but separate supporting documents such as the contract for the change of rights are needed. The application must state the subject's name and address, or name and resident registration number, accurately, so check the personal details on the loan agreement or contract in advance.
2. Send a certified letter and keep the returned mail
Send a certified letter stating the details of the claim and a request for repayment to the last address the debtor gave you. The notes to Annex 1 of the Enforcement Rule require the returned certified letter to contain content showing a legitimate interest such as a creditor-debtor relationship, so state the loan date, amount and repayment date specifically in the letter. Keep the original mail returned as addressee unknown or address unknown, together with its envelope.
3. Prepare the certificate of interested-party facts
The administrative agent checks the personal details of the creditor and debtor, the repayment date, the debt amount and the nature of the debt using materials such as the loan agreement, bank transfer records and message records, completes the certificate of interested-party facts section of the Form No. 11 application, writes the issue number and affixes a seal. A certificate without an issue number, or a copy, is not accepted as evidence, and the administrative agent who issues it must keep an issuance ledger for certificates of interested-party facts using Form No. 12. If you have a contract bearing both signatures or seals and the repayment date, you can instead attach that contract to the Form No. 7 application without a certificate.
4. Apply for the abstract at a community service center or similar office
The applicant personally submits the application and the returned certified letter, with an ID card, at a city, county or district office or an eup, myeon or dong community service center. Another person's abstract cannot be obtained by electronic document or unmanned civil service kiosk, and the fee is 500 won per copy. The purpose stated in the 'use and purpose' field is shown on the abstract issued, so it must be filled in.
5. Review the abstract and prepare the next steps
An abstract issued on the basis of a creditor-debtor relationship omits the last digits of the resident registration number, the name of the head of household and relationship, past address changes and military service details, and mainly shows the current address. Use the confirmed address to resend the certified letter or for the next collection steps. The issuing office may refuse issuance if it considers there is a risk of invading privacy, and must give the reason in writing.
