How to Obtain a Real Estate Market Price Confirmation Certificate — For Inheritance, Gifts and Court Submission, and Setting the Reference Date
A real estate market price confirmation certificate is a document that sets out the market price of a specific property as of a fixed date, based on research into its officially announced price, actual transaction prices and nearby transaction cases. It is used to decide whether to renounce an inheritance, to review a gift between family members, and as material submitted to courts and administrative agencies. For the document to be useful, first decide where it will be submitted and which date it is based on.
Procedure
1. Confirm the recipient and the purpose
First decide where the document will be submitted: a court, an administrative agency, a financial institution, discussion among family members, and so on. Check whether the recipient requires a particular format and whether the procedure is one for which statutes require a different document (such as an appraisal report). A market price confirmation certificate cannot replace a document prescribed by statute.
2. Set the reference date
Set the date that serves as the basis, such as the date the inheritance commenced for an inheritance, the date of the gift for a gift, and the date in dispute for litigation. If the reference date differs, the market price differs even for the same property.
3. Research the materials
Identify the property with the certificate of registered matters and the building register, and collect the officially announced price, the actual transaction prices published by the Ministry of Land, Infrastructure and Transport, and transaction cases of similar properties in the same complex or nearby from before and after the reference date. Also note rights registered on the property, such as a maximum-amount mortgage or provisional attachment.
4. Prepare the market price confirmation certificate
Write down the research method, the sources of the materials, the reference date, and the comparison cases and how they differ, so that anyone can see how the market price was arrived at. Facts that the administrative agent investigated directly can be issued together in the form of a fact confirmation certificate.
Required documents
- No prescribed submission form (a market price confirmation has no statutory form, so it is prepared to match the items required by the place of submission)
- Address of the property and its certificate of registered matters
- Building register and land register
- Materials showing the recipient and the purpose (court order for correction, guidance notice from the agency, etc.)
- Materials confirming the reference date (date of death, contract date, etc.)
- Identification materials of the client
Fees
Fees for preparing a real estate market price confirmation certificate generally range in the industry from tens of thousands of won to several hundred thousand won per case and vary with the number of properties, the scope of research and whether a fact confirmation certificate is issued at the same time. We will tell you the fee after a consultation, based on the property and the purpose.
Legal basis and review date
- Certified Administrative Agents Act, Article 2
- Act on Report on Real Estate Transactions, Etc., Article 3
- Civil Act, Article 1019
Check these first
- If the reference date is set wrongly, the document must be prepared again, so first check the date basis in the recipient's guidance notice.
