Requirements for Participating in Regionally Restricted Competitive Bidding — The 180-Day Head Office Location Standard and Advance Preparation

When a local government announces a contract below a certain amount as a regionally restricted bid, only businesses whose head office on the corporate register (for an individual, the place of business stated in the business registration or a similar record) is in the metropolitan city or province (si/do) where the construction site or delivery location is situated may participate. A bidder must have its head office in that metropolitan city or province from 180 days before the bid notice date until the bid date, and the successful bidder until the contract date. Moving the head office just before the notice does not satisfy the requirement, so prepare in advance.

Procedure

  1. 1. Read the restrictions in the notice

The procuring agency must state the restrictions and the standards for them in the bid notice. First check in the notice the scope of the regional restriction (whether it covers the relevant metropolitan city or province only, or extends to adjacent metropolitan cities or provinces), the required business type, and the performance record or construction capability standards.

  2. 2. Calculate the period of head office location

The head office must be located in the relevant metropolitan city or province (si/do) continuously from 180 days before the bid notice date until the bid date. A new business that completed corporate registration or business registration during that period qualifies if it has been in that metropolitan city or province continuously from the date of corporate registration or the date of business registration. The successful bidder must keep its head office there until the contract date.

  3. 3. Match the business type registration and the Nara Jangteo (KONEPS) information

Hold the business type registration required by the notice, such as landscape planting or landscape facility installation, and check that the business type and address in the Nara Jangteo bidding qualification registration information match the facts. If the head office has been moved, the corporate register, the business type registration and the Nara Jangteo information must all be corrected.

  4. 4. Prepare construction capability, performance record and credit rating documents

For general construction works with an estimated price of 3,000,000,000 won or more, and for specialized construction works of 300,000,000 won or more, eligibility to participate may be restricted by construction capability or by a record of the same type of work, and the construction capability standard is set within 2 times the estimated price. Prepare the credit rating confirmation certificate and other documents used in the qualification examination so that they match the reference date set in the notice.

  5. 5. Secure bonus-point certifications before the notice

Certifications that earn bonus points in the qualification examination, such as women-owned business, business owned by persons with disabilities and Family-Friendly Certification, are in many cases reflected only if they are held as of the notice date. If you are planning to bid, obtain the certifications first.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • The date of registration of the head office relocation is the reference point for the 180-day calculation. If you plan a relocation, count back from the timing of the notice you intend to join and set the schedule.

Frequently asked questions

If we move the head office to Incheon just before the notice, can we join an Incheon regionally restricted bid?
No. The head office must be in the relevant metropolitan city or province (si/do) from 180 days before the bid notice date until the bid date, so a move just before the notice does not satisfy the requirement. However, a new business that was newly established or completed business registration within that period qualifies if it has been there continuously since then.
If we have a branch in Incheon, can we enter a regionally restricted bid?
The standard is the location of the head office on the corporate register. Even if a branch or factory is in the region, there is no eligibility to participate if the head office is in another metropolitan city or province (si/do).
Can a business from another metropolitan city or province (si/do) take part in a regionally restricted bid?
Only where the notice extends the regional scope to adjacent metropolitan cities or provinces. In that case too, the head office location period requirement applies in the same way, with the adjacent metropolitan cities or provinces included.
May we move the head office after winning the bid?
Not until the contract date. The successful bidder must have its head office in the relevant metropolitan city or province (si/do) until the contract date, so if you plan to relocate, postpone it until after the contract is concluded.
Does an administrative agent help with preparing for public bids?
Yes. Hwang Yunsang Administrative Office handles Nara Jangteo bidding qualification registration, checks the eligibility documents for each notice, and prepares and files application documents for bonus-point certifications such as women-owned business and Family-Friendly Certification on your behalf.
